These Terms and Conditions govern the provision of all services by G&T Express Ltd. Please read them carefully before placing an order or instruction with us. By using our services, you agree to be bound by these Terms.
1. Definitions
In these Terms and Conditions:
"Company" means G&T Express Ltd, registered in England & Wales, with its principal place of business at 227a Elliott Street, Tyldesley, Greater Manchester, M29 8DG.
"Customer" means any person, firm, or company that places an order or instruction with the Company for the provision of services.
"Services" means any transport, courier, haulage, freight forwarding, warehousing, or related logistics services provided by the Company.
"Consignment" means any goods, parcels, pallets, or freight accepted by the Company for carriage or storage.
2. Application of Terms
These Terms and Conditions apply to all Services provided by the Company to the Customer and supersede any previous terms. No variation to these Terms shall be binding unless agreed in writing by a director of the Company. By placing an order or instruction with the Company, the Customer agrees to be bound by these Terms.
3. Quotations and Pricing
All quotations provided by the Company are valid for 7 days from the date of issue unless otherwise stated. Quotations are based on information provided by the Customer at the time of enquiry. The Company reserves the right to revise a quotation if the actual details of the Consignment differ materially from those provided. All prices are exclusive of VAT unless otherwise stated. The Company operates a strict no fuel surcharge policy — the price quoted is the price invoiced.
4. Booking and Instructions
The Customer is responsible for ensuring that all booking information provided to the Company is accurate and complete, including collection and delivery addresses, contact details, goods description, weight, and dimensions. The Company shall not be liable for any loss, delay, or additional cost arising from inaccurate or incomplete instructions provided by the Customer.
5. Carriage and Delivery
The Company will use reasonable endeavours to collect and deliver Consignments within agreed or estimated timeframes. However, all transit times are estimates only and the Company shall not be liable for any loss or damage arising from delay unless caused by the Company's gross negligence or wilful default. The Company reserves the right to sub-contract any part of the Services to third parties without prior notice to the Customer. We offer 30 minutes free loading time on vehicles up to a luton sized van and 1 hour on vehicles above that size at both collection and delivery point. Above that waiting time will be incurred.
6. Dangerous and Prohibited Goods
The Customer must not tender for carriage any goods that are prohibited by law, classified as hazardous or dangerous goods under applicable regulations (including ADR), or that require special handling without prior written agreement from the Company. The Customer shall indemnify the Company against all losses, costs, and liabilities arising from the carriage of undisclosed dangerous or prohibited goods.
7. Liability and Limitation
The Company's liability for loss of or damage to a Consignment shall be limited to the lesser of: (a) the actual value of the goods lost or damaged; or (b) £1,300 per consignment, unless the Customer has declared a higher value in writing prior to collection and the Company has agreed in writing to accept enhanced liability.
The Company shall not be liable for: indirect or consequential loss; loss of profit, revenue, or business; loss arising from delay; or loss or damage caused by inadequate or improper packaging by the Customer.
Nothing in these Terms limits the Company's liability for death or personal injury caused by its negligence, or for fraud or fraudulent misrepresentation.
8. Insurance
The Company maintains appropriate goods in transit insurance. Customers requiring additional cover for high-value consignments should declare the value at the time of booking. The Company can arrange additional insurance cover upon request, which may be subject to additional charges.
9. Claims
Any claim for loss or damage must be notified to the Company in writing within 3 days of delivery (or, in the case of non-delivery, within 7 days of the expected delivery date). Claims not notified within these timeframes may be rejected. The Company shall not be liable for any claim where the Customer has failed to retain all relevant documentation, including proof of value.
10. Payment Terms
Unless otherwise agreed in writing, invoices are payable within 30 days of the invoice date. The Company reserves the right to charge interest on overdue amounts at the rate of 8% per annum above the Bank of England base rate, pursuant to the Late Payment of Commercial Debts (Interest) Act 1998. The Company reserves the right to suspend Services in the event of non-payment.
11. Warehousing and Storage
Where the Company provides warehousing or storage services, goods are stored at the Customer's risk unless the Company has been negligent. The Company shall not be liable for deterioration of goods arising from their inherent nature or inadequate packaging. The Customer is responsible for ensuring that goods are adequately described and labelled for storage purposes.
12. Data Protection
The Company processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Personal data provided by the Customer will be used solely for the purposes of providing the Services and will not be shared with third parties except where necessary to fulfil the Services or as required by law.
13. Force Majeure
The Company shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, extreme weather, strikes, civil unrest, government action, or road closures.
14. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
